Trial Measures of Hubei Province on Administration of the Transference and Cession of the Use Right of the Construction Land under the Collective Peasant Ownership
Article 1. With a view to enhancing the administration of the Transference and Cession of the use right of the construction land under the collective peasant ownership (hereafter referred to as the use right of the collective construction land), safeguarding the rights concerning the collective land of the peasants, promoting the optimum allocation and intensive utilization of land resources, accelerating the construction of rural industrialization, agricultural industrialization and urbanization, these Trial Measures are formulated pursuant to the relevant provisions of the State and in light of the actual situation of the Province.
Article 2. The use right of the collective construction land in these Trial Measures shall refer to the use right of the collective construction land, whose ownership is legal and clearly defined, in a village and town, or an organic town in line with the overall planning and city planning of the land use.
The transference and cession of the use right of the collective construction land shall refer to the acts of transferring the use right of the collective construction land under the premise of the collective land ownership, encompassing the selling, leasing, transferring, subleasing, mortgaging, buying a share and other transference and cession acts negotiated and agreed upon by both parties.
Article 3. The principle of legality, equality, free will and compensation shall be adopted in the transference and cession of the use right of the collective construction land.
Regarding the land use for public facilities and public welfare undertakings of the collective itself and for the legal homestead of a peasant family, the construction land under the collective ownership shall be used without charges.
Article 4. The function of the collective construction land after the transference and cession of the use right shall comply with the overall planning and the village and town planning for land utilization; it shall comply with the city planning if the land to be used is within the city planning area.
